Restaurant Music Licensing Fees Getting Enforced More Consistently By BMI, ASCAP and SESAC

There’s a lot of overlap between restaurant lovers and music lovers, so it’s not hard to imagine that, if you open a restaurant, you have a favorite band. But before you plug your iPod into the new speaker system in your Mexican-Ghanaian-Tamil fusion joint in Albuquerque, hoping to blast your favorite mashup of Taylor Swift and Ghostface Killah, there’s something you need to do: buy the rights.

That’s because, according to TJ Jacobberger at Inside Scoop SF, music rights owners BMI and ASCAP have grown increasingly vigilant about enforcing their licensing agreements with restaurants over the past several years. Apparently, the two companies, which each own the rights to millions of songs, have sued more than two dozen restaurants for copyright infringement. These violations can be costly. One contentious case from a couple years ago involved Seattle restaurant Ibiza, which had not paid to use ASCAP’s music. The rights managers asked the restaurant to pay a fee of $30,000 as remuneration.

Even if any little restaurant is unlikely to be caught by BMI and ASCAP’s anonymous inspectors, the steepness of the fees makes paying for the rights to use music seem like a relatively easy decision. Rights aren’t even that expensive. BMI’s website quotes a fee of $2.45 per restaurant occupant per year, meaning that even a huge, 200-seat restaurant would only end up paying about $500 per year. (ASCAP does not post rates on its website.) And the National Restaurant Association has put together an easily comprehensible primer on the subject for would-be restaurant DJs.

The other option is to hire a background music company like Prescriptive Music, which takes care of licensing itself. They offer a completely custom program that acts like your own iPod, but legal! You can also avoid fees if you install a paid jukebox from a licensed operator. But then you run the risk of have music-free periods if customers don’t want to pay for music.

Central 24/7 by Michel Richard, the newest restaurant in the Caesars Palace hotel, has selected Prescriptive Music to provide their music vibe. The new Las Vegas restaurant, replacing the Augustus Cafe in the Caesars Palace lobby, is a version of the popular Washington, D.C. venue by James Beard Award-winning Chef Michel Richard.
Central 24/7 by Michel Richard will feature a menu of classic American dishes with a French flair, like Richard’s popular burger, 72-hour short ribs, razor clam chowder, fresh oysters, and fried chicken. This 9,600 square-foot restaurant features an outdoor patio and a lounge with a full bar. It will be open 24-hours a day, for breakfast, lunch, and dinner.

Zislis’s The Strand House Takes Contemporary Dining to a New Level

The Strand House, a new Manhattan Beach restaurant by the Zislis Group, ran by Michael and David Zislis, opens August 11 with a sophisticated menu, relaxing setting, and world-class dining experience.The Zislis Group calls the space”elegant and dramatic” and the tone “welcoming and casual,” both of which will be enhanced by Prescriptive Music’s playlists.

The Strand House elevates fine dining with a contemporary menu and modern setting. The beachfront property features a glass facade that overlooks the beach, with doors that can open to create a semi-outdoor dining area.

The four story building also features a wine cellar. The Strand House will cater a relaxing yet sophisticated and hip dining experience for its clientele.

The music at The Strand House reflects that same causal yet dramatic vibe. The playlists feature indiepop like Fleet Foxes, Broken Bells, and Foster the People, with sprinklings of adult contemporary like Ben Harper, Coldplay, and Dave Matthews Band. The midtempo music acts as the perfect background playlist to underscore a unique and exquisite dining experience.

After the House Warming Party on August 9, The Strand House will be open for walk-ins on August 11, and will begin taking reservations on September 1.

Chef Neal Fraser is designing and consulting the menu, and will be working with Executive Chef Travis Lorton and Pastry Chef Seth Caro. The menu features luxurious and “colorful” spins on classic dishes.

Prescriptive Music and Gyu-Kaku teamed up to revamp and restyle the music for the popular Japanese Yakiniku spot in Sherman Oaks. Prescriptive Music’s programmers updated the restaurant’s soundtrack with two distinct sounds: one for the main restaurant and one for the outdoor patio and bar.

The main restaurant features chill, mid-tempo lounge music with hints of acid jazz. This blend of cool music enhances the atmosphere of the fun open-pit barbe-que place, where guests cook their own meat and vegetables over grills on their tables. In the outdoor patio and the bar, guests can groove and chill to top 40 hits, indie pop, electro pop, and indie rock.

Gyu-Kaku is unique in that the guests are involved in the cooking process – they are free to create their own meal. Gyu-Kaku features a wide range of meats – from short ribs to filet mignon – as well as chicken, seafood, and vegetables to cook over the built-in charcoal grill. The extensive menu also includes appetizers like edamame, soups, salads, calamari, and rolls, sides like noodles, bimbimbap, and rice, and irresistible deserts like s’mores and chocolate lava cake.
